Why a foreign document should not decide too quickly

A foreign will can be decisive in Austrian probate. It may also be only a copy, an incomplete translation or a document with formal issues.

No one should accept or contest too quickly. First organise original, language, place of execution, date, form, authenticity and connection to Austria.

How formal validity and authenticity are separated

The EU Succession Regulation, especially Article 27, may matter for formal validity of testamentary dispositions with a foreign element. But it does not answer every evidentiary question.

Authenticity concerns different points: Who signed? Are there witnesses? Is the copy complete? Does the translation fit? Are there registers, apostille or legalisation?

What role translation and certification play

A foreign language document must be understandable and reliable for the procedure. Unclear translations can shift the content and create new dispute points.

Apostille, legalisation or other certification are not mere decoration. They can help classify origin and authenticity. Whether they are necessary depends on the state and the document.

How participants proceed in Austrian probate

Participants should file the document completely, state doubts precisely and disclose the foreign element. General claims such as foreign wills never count or everything is automatically valid rarely help.
