The article is not a general guide to inheritance contracts. It deals with the conflict when an old contract resurfaces after a relationship change.

Overview of all answers.

01

Put the evidence in order first.

Secure documents with date, origin and context. Only then can it be assessed whether the suspicion is legally sustainable.

02

Do not examine valuation in isolation.

Valuation issues depend on the estate, encumbrances and the specific legal basis. An expert valuation does not replace legal assessment.

03

Deadlines and preservation before tactics.

Where deadlines are running or assets are at risk, preservation should be examined first. Settlement talks do not replace reliable deadline control.

What must be read first in the old contract

The exact text comes first. Who is bound? Are there revocation rights, termination clauses or references to a marriage? Without reading the contract every assessment is uncertain.

Amendments, divorce agreements and later wills must be read together. A later will does not automatically remove a contractual bond.

Why separation and divorce do not solve everything

After separation, legal bonds do not always continue as the parties expect. Conversely, a relationship change does not automatically make every inheritance contract disappear.

The contract, timing, divorce documents and later declarations are decisive. They show whether reliance on the contract is still sustainable.

Who is typically affected

Former spouses, new partners, children and heirs can all be affected. Each perspective is different: one side relies on binding effect, the other on later life changes.

The dispute often sits near contesting a will and inheritance dispute.

How to prepare a solution

Before litigation it should be clarified whether interpretation, settlement or contesting is central. That depends on the contract and evidence.

A timeline is useful: contract, separation, divorce, new disposition, death and the parties first reaction.

For an inheritance contract the exact text matters. Separation, divorce and later wills must be compared with that text.
