Everyday family language often calls everyone a child, although legal roles differ. In probate, what matters is not only who lived in the household or cared for the deceased, but which legal status can be proven.
Stepchildren in particular often expect participation after years within the family. Without adoption or testamentary disposition, that expectation may be assessed differently in law than it feels personally.
Section 197 ABGB gives adoption effects similar to parentage. Section 199 ABGB deals with inheritance effects in relation to biological and adoptive lines. The adoption order is therefore a key document.
In a dispute, date, scope and any later revocation or cancellation must be reviewed carefully. Small differences can affect who is statutory heir or who has compulsory portion rights.
For stepchildren without adoption, the review shifts to will, legacy, gifts, care services and written promises. This still does not automatically create heirship, but other claims or dispute points may exist.
Expectations should not be mixed with legal positions. A stepchild asserting or resisting rights should first secure documents, payments and the last will.
